(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts for the rental of event technology and the use of associated services concluded via the platform renty-event.com, by email, telephone, WhatsApp, or in any other way with Renty DIP GmbH & Co KG (hereinafter "Renty" or "Lessor").
(2) The customer's contractual partner (hereinafter also referred to as "renter") is exclusively Renty DIP GmbH & Co KG. Depending on the location, Renty provides the contractual services either itself or through carefully selected local partner companies acting on behalf of and for the account of Renty. In any case, Renty remains the renter's contractual partner and point of contact.
(3) These Terms and Conditions apply exclusively. Customer terms that contradict or deviate from these Terms and Conditions will not be recognized unless Renty has expressly agreed to their validity in writing. This also applies if Renty provides the service without reservation while aware of conflicting or deviating customer terms.
(4) For the purposes of these Terms and Conditions, a consumer is any natural person who enters into the contract for purposes that are predominantly outside their trade, business, or profession. A business is any natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding the contract. Where these Terms and Conditions distinguish between consumers and businesses, this is explicitly indicated.
(5) Supplementary or deviating agreements between Renty and the customer must be in text form (e.g., email).
(1) At the time of booking, the renter must be of legal age and have full legal capacity.
(2) The presentation of equipment and services on the website does not constitute a binding offer, but rather an invitation to the customer to make a booking.
(3) When booking via the booking system on renty-event.com, the customer submits a binding offer to enter into a rental agreement by completing the ordering process via the button marked as subject to payment. This is conditional upon the customer having previously actively accepted these Terms and Conditions. The contract is concluded upon confirmation of the booking by Renty (e.g., via booking or order confirmation or provision of the contract).
(4) Alternatively, the customer may submit a non-binding inquiry via email, telephone, WhatsApp, or in writing. Based on this, Renty will prepare an individual quote. Unless a different period is specified in the quote, it remains valid for two weeks; the date will be reserved for this period. The contract is concluded upon the customer's acceptance of the quote.
(5) Renty reserves the right to cancel individual bookings in justified exceptional cases, such as equipment unavailability, short-notice illness, or if a booking is technically unfeasible. In such cases, Renty will fully refund any payments already made. Further claims are subject to Section 10 (Liability).
(6) If the specifically booked equipment is unavailable, Renty is entitled to provide the renter with equivalent or superior equipment at no additional cost.
(7) 24-hour rental cycle: A "one-day" rental period is defined as a duration of 24 hours, for example, from 6:00 PM to 6:00 PM the following day.
(1) The subject of the contract is the temporary provision of the equipment and associated accessories specified in the contract or booking in exchange for payment of the agreed rental price.
(2) The renter can select additional services during the booking process or as part of an individual offer. The following services are available:
a) Self-pickup: free of charge. The renter picks up the equipment from a location and returns it there; a personal briefing is included.
b) Delivery: Personal delivery to and collection from the specified address by Renty.
c) Setup & Dismantling: Setup, soundcheck, and dismantling by a Renty employee.
d) Event Support: Technical support during the event by a Renty employee.
The paid services (delivery, setup & dismantling, event support) are billed per started hour. The prices applicable for these may vary depending on location and effort. The price relevant to the specific booking is shown to the customer in the booking system (checkout) or in the individual offer before the contract is concluded and is binding at the stated amount. All prices shown to consumers are gross prices including VAT.
(3) Subsequent billing of additional expenses: For the "Delivery" and "Setup & Dismantling" services, one hour is included in the booked price. If the actual effort (e.g., travel, waiting time, setup and dismantling) exceeds the included hour, the additional time will be invoiced subsequently for each started hour at the hourly rate applicable to the booking. The possibility of subsequent billing and the applicable hourly rate are pointed out during the booking process. Renty will endeavor to coordinate any expected additional expenses with the renter in advance whenever possible. Subsequently invoiced amounts must be paid within 14 days of the invoice date.
(4) Audio Cable Guarantee: With the Audio Cable Guarantee, Renty ensures that the renter receives the appropriate cable accessories for their specific use case (e.g., XLR, jack, AUX) upon pickup or delivery, without having to choose from a multitude of different cables themselves. For special or atypical requirements, such as very long cabling distances or unusual cable types that would need to be specially procured, appropriate provision cannot be guaranteed in every case. Such special requirements should be coordinated with Renty before the start of the rental if possible.
(5) Photo Booth: The following applies additionally to the rental of photo booths:
a) If the renter desires a custom layout (e.g., a specific background image or print layout), they must submit the necessary specifications at least 2 days (48 hours) before the start of the rental. If the submission is not made in time, a standard layout will be used.
b) If a print flat rate is booked, each booking includes up to 400 prints for the Fotobox Print Pro and up to 150 prints for the Fotobox Print. Once the respective limit is reached, the images remain available in a digital gallery; additional print material can be booked as an option.
c) If printer issues occur due to improper operation, there is no entitlement to a refund. If a printer issue is proven to be caused by a defect present at the time of handover, Renty will refund the proportional costs for the unusable print material; no further claims exist.
(1) The rental price specified in the contract or booking system, which is based on the estimated rental duration, is binding. Early return does not lead to a reduction in the rental price. All prices quoted to consumers are gross prices and include the applicable VAT.
(2) Unless expressly agreed otherwise, the rental price must be paid in advance. Online bookings via the platform are exclusively subject to prepayment.
(3) Payment is processed via the payment service providers integrated into the booking system (checkout) and the payment methods offered there. Depending on availability, these include credit cards (e.g., Visa, Mastercard, American Express), PayPal, Apple Pay, Google Pay, Klarna, and other methods displayed at checkout. The currently available payment methods are shown to the customer during the booking process.
(4) The customer may only offset Renty's claims against counterclaims that have been legally established, are undisputed, or have been acknowledged by Renty. The customer is only entitled to a right of retention if their counterclaim is based on the same contractual relationship.
(5) Invoicing and Reverse Charge: The total amount includes the applicable VAT in accordance with tax regulations. If the recipient of the service is a business entity based in the EU outside of Austria, the reverse charge procedure may apply; in this case, the tax liability is transferred to the recipient of the service in accordance with Art. 196 of the VAT Directive 2006/112/EC. For appropriately qualified companies with a valid VAT ID number, a net invoice will be issued with a note regarding the transfer of tax liability; any VAT paid in advance will be refunded using the same payment method used for the original transaction, unless otherwise agreed. By completing the booking, the customer acknowledges this provision.
(6) Identity verification: Renty is entitled to verify the customer's identity before the start of the rental, for example by requesting a government-issued photo ID or through a third-party verification process. To prevent fraud and secure the equipment, the vehicle license plate may also be recorded during pickup or handover. The legal basis for this is Renty's legitimate interest in preventing fraud and protecting property (Art. 6 (1) (f) GDPR). Only data necessary for this purpose will be processed; it will be deleted as soon as it is no longer required. Details are set out in the Privacy Policy.
(1) The rental period is determined by the contract or booking. The equipment must be returned or made available for the agreed pickup no later than the agreed time on the final day of the rental period, or on the next possible business day.
(2) If the renter returns the equipment late or fails to adhere to agreed handover or return times, the standard daily rental rates as stated on the website will be charged for the period of delay. In addition, Renty may claim for any additional expenses caused by the delay in accordance with Section 10 (7).
(3) If the renter fails to appear or does not arrive on time for the agreed pickup or return, Section 10 (7) (compensation for expenses) shall apply accordingly.
(4) Return inspection: The inspection of the equipment for damage is carried out together with the renter upon return whenever possible. Renty is entitled to inspect the returned equipment within 3 working days after return and to assert any damage found that is attributable to the renter even after the renter has departed, provided that Renty documents and proves this. The burden of proof for the attribution of the damage lies with Renty.
(1) Regardless of the statutory right of withdrawal, the customer may cancel a booking. In the event of a cancellation, we charge the following cancellation fees:
Cancellation up to 14 days before the start of the rental: 0% of the order total
Cancellation less than 14 days before the start of the rental: 25% of the order total
Cancellation less than 7 days before the start of the rental: 50% of the order total
Cancellation less than 3 days before the start of the rental: 75% of the order total
Cancellation less than 1 day before the start of the rental: 100% of the order total
If delivery is booked, the agreed delivery day is considered the start of the rental period.
(2) The customer may prove that Renty incurred no damage or significantly less damage than the respective flat rate. In this case, the cancellation fee will be reduced accordingly or waived. The statutory rights of the consumer, in particular the right of judicial mitigation, remain unaffected.
(3) If Renty cancels a booking according to §2 para. 5, Renty will fully refund any payments already made by the customer.
(1) As a general rule, Renty does not charge a deposit for bookings.
(2) Renty reserves the right to charge a reasonable deposit in justified exceptional cases, particularly for high-value equipment (e.g., the DJ equipment category). In this case, Renty will inform the renter about the amount of the deposit and the payment method (cash or bank transfer) before the start of the rental period.
(3) The deposit will be refunded after the equipment has been returned in proper condition and its state has been checked, no later than 14 days after return. Renty is entitled to offset any due and fixed claim for damages or outstanding payments against the deposit; any remaining balance will be refunded.
(1) The renter is obliged to check the equipment for completeness and damage immediately upon receipt and to test its functionality. Any pre-existing damage or defects must be reported to Renty immediately and should be recorded in a designated report.
(2) The equipment must be handled with care during the rental period, used exclusively for its intended purpose, and operated only in accordance with the safety and operating instructions. It must be set up and operated in such a way that it does not endanger persons or property and does not block passageways or emergency exits. In particular, the renter must ensure that the equipment is protected from weather influences, water, fire, and similar effects, unless it is expressly intended for such use.
(3) Assumption of risk: The risk for the equipment passes to the renter upon handover; in the case of self-collection, upon pickup; and in the case of delivery, upon handover at the delivery address. During a delivery or pickup carried out by Renty, Renty bears the transport risk until or from the point of handover.
(4) The renter is liable for damage to the equipment as well as for its loss, which is culpably caused by them or by persons to whom they entrust the equipment during the rental period (breach of the duty of care and custody).
(5) Deductible instead of deposit: Renty provides the equipment without a deposit and with insurance. In return, the renter bears a deductible in the event of damage. For damage covered by Renty's equipment insurance, the renter's liability is limited to a deductible of €250.00 (gross) per affected product; the equipment insurance covers any damage exceeding this amount. If the actual damage to an affected product is less than €250.00, only the actual, lower amount is to be paid. The renter may prove that they are not at fault or that no damage or less damage occurred; in this case, the deductible is waived or reduced accordingly.
(6) In the event of damage due to theft despite sufficient securing of the equipment (e.g., locked door), theft from a motor vehicle, or robbery, the deductible is 25% of the damage amount, but at least €250.00 (gross) per affected product. In these cases, for proper insurance processing, the renter must immediately file a police report—in cases of doubt, against an unknown perpetrator—and forward it to Renty.
(7) For damage not covered by the equipment insurance, in particular damage outside the insurance territory according to paragraph 9, as well as damage caused intentionally or through gross negligence by the renter, the renter is liable for the full amount of the actual damage, without limitation to the deductible.
(8) Cleaning and damage costs: If the equipment is not returned in a proper, cleaned condition, Renty is entitled to subsequently invoice the necessary cleaning costs as well as costs for scratches and other damage. The corresponding amounts must be paid within 14 days of the invoice date. If payment is not made within this period, dunning proceedings will be initiated; the customer shall bear the resulting additional costs within the scope of the law.
(9) Insurance territory: Renty's equipment insurance applies exclusively to damages occurring within the European Union and Switzerland. If the equipment is located outside this territory, there is no insurance coverage; in this case, the renter is fully liable for all damages, losses, or thefts. The renter undertakes to use the equipment exclusively within the aforementioned territory.
(1) Renty provides the renter with functional equipment suitable for the intended use under the contract.
(2) If the equipment shows a defect for which Renty is responsible upon handover or during the rental period, the renter must notify Renty immediately so that Renty has the opportunity to provide a remedy (e.g., replacement or provision of an equivalent device). The consumer's statutory warranty and defect rights remain unaffected.
(3) If the renter fails to provide a reasonable and timely notice of defects, this may reduce their claims within the statutory framework, provided that Renty is thereby deprived of the opportunity to provide a remedy.
(1) Renty is liable without limitation for damages resulting from injury to life, body, or health caused by a negligent or intentional breach of duty by Renty or a legal representative or vicarious agent of Renty, as well as for other damages caused by an intentional or grossly negligent breach of duty by Renty or a legal representative or vicarious agent of Renty.
(2) In the event of a slightly negligent breach of an essential contractual obligation, the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the customer may regularly rely (cardinal obligation), Renty's liability is limited to the typical, foreseeable damage.
(3) Otherwise, Renty's liability for slight negligence is excluded.
(4) Liability according to mandatory statutory provisions, in particular the Product Liability Act, as well as for expressly assumed guarantees, remains unaffected.
(5) Renty provides services in part through local partner companies, which act as Renty's vicarious agents. Renty is liable for their fault within the scope of the preceding paragraphs. If a booking cannot be carried out for any reason, Renty will refund the amount already paid by the customer; further claims are governed by the preceding paragraphs.
(6) Force Majeure: If a service cannot be provided or cannot be provided on time due to events beyond Renty's control (e.g., natural disasters, strikes, official measures, failure of suppliers, unforeseeable technical defects), Renty is released from its obligation to perform for the duration of the impediment. Amounts already paid for services not rendered will be refunded.
(7) Compensation for expenses: If the customer does not accept the booked products or packages, fails to collect them, or does not adhere to agreed handover or return times, the full rental fee becomes due. Additionally, Renty may charge compensation for the additional labor time caused by this, calculated per started hour at the hourly rate applicable for services at the respective location. The customer reserves the right to prove that no expense or a lower expense was incurred.
(7) Customer liability for consequential damages: The customer is liable for damages incurred by Renty due to late return, damage, or loss of the equipment. In dealings with businesses, this also includes lost revenue resulting from the unavailability of the equipment for subsequent orders. In dealings with consumers, liability for such consequential damages is limited to the typical damage foreseeable at the time of contract conclusion.
(9) Supplementary provisions for businesses (B2B): In dealings with businesses, Renty's liability for slight negligence, even in the event of a breach of essential contractual obligations, is limited to the amount of the typical, foreseeable damage, and in any case to a maximum of the agreed rental fee for the order in question; liability for indirect damages, loss of profit, and business interruption is excluded in cases of slight negligence. Paragraphs 1 and 4 remain unaffected.
(10) Where Renty's liability is excluded or limited, this also applies to the personal liability of Renty's legal representatives, employees, and vicarious agents.
(1) Consumers have a statutory right of withdrawal. Businesses do not have a right of withdrawal.
Cancellation Policy
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us (Renty DIP GmbH & Co KG, Klosterwiesgasse 7, Top 1-3, 8010 Graz, Austria, email: office@renty-event.com, phone: +49 160 98293373 or +43 316 231064) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, though it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall refund all payments we have received from you without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund. If you requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you informed us of the exercise of the right of withdrawal regarding this contract, compared to the total scope of the services provided for in the contract.
(2) Early commencement and expiration of the right of withdrawal: If the rental start date or the date of the booked service falls within the fourteen-day withdrawal period, Renty will only begin performance if the consumer has expressly requested this. By booking a date within the withdrawal period and confirming these General Terms and Conditions, the consumer expressly requests that Renty begin the service before the withdrawal period expires and confirms their awareness that their right of withdrawal expires upon full performance of the service. In the event of only partial performance, the consumer owes the aforementioned proportional compensation for value in the event of withdrawal.
(3) The right of withdrawal also expires for contracts regarding equipment that has been assembled or manufactured according to the customer's individual requirements in such a way that it cannot be used elsewhere.
(4) Relationship to cancellation policy: If the consumer exercises their right of withdrawal in due time, the consequences of this §10 (refund, and if applicable, proportional compensation for value) shall apply.
